These Terms of Service constitute a legally binding contract between users of this website and CaptionMatch. We reserve the right to revise these Terms of Service at any time in our sole discretion by updating this page. Unless otherwise provided, any revised terms will take effect when posted.
CaptionMatch is an online service that enables providers of captioning services (“Providers”) to search for people and organizations who need captioning (“Consumers”). Providers are either Responding Providers or Subscribing Providers. Responding Providers can respond to Consumer captioning requests. In addition to responding to Consumer requests, the CaptionMatch service allows Subscribing Providers to post requests if they need subcontractors for a captioning project. All requests must be posted a minimum of one week before the planned service date. Thus, the website contains features that:
- Allow people and organizations to post details of their captioning requirements
- Allow captioning providers to review those requirements and submit proposals
To access services provided by CaptionMatch, Consumers and Providers must register. By registering, you confirm that:
- You are a legal entity, or an individual of eighteen years of age or older who can form legally binding contracts.
- You accept all of the terms and conditions in, incorporated by reference in, and linked to, these Terms of Service.
- You agree to provide true, accurate and complete information on the registration form and all forms you access on the website, and to advise CaptionMatch of any changes to this information to maintain its truthfulness, accuracy and completeness.
- You agree to perform your obligations as specified by any CaptionMatch captioning assignment, unless such obligations are prohibited by law or by the Terms of Service.
- You agree to send CaptionMatch a summary of progress on all captioning assignments resulting from CaptionMatch connections once every two weeks, at a minimum.
CaptionMatch reserves the right, in its sole discretion, to refuse, suspend, or terminate services to anyone. Without limiting our other remedies, we may issue a warning, or temporarily suspend, indefinitely suspend or terminate your account, and refuse to provide any or all services to you if: (1) you breach the letter or spirit of any terms and conditions of these Terms of Service or the linked policies and information incorporated herein by reference, including our written policies and procedures posted on the website; (2) we are unable to verify or authenticate any information you provide to us; or (3) we believe in our sole discretion that your actions may cause legal liability for you, other registered Consumers or Providers or are contrary to the interests of CaptionMatch. Once indefinitely suspended or terminated, you must not continue to use the website under the same account, a different account, or register under a new account.
Any agreement made between a Provider and a Consumer is between the Provider and Consumer. Also, any agreement made between a Subscribing Provider and a Responding Provider as a subcontractor to the Subscribing Provider is between the Subscribing Provider and the Responding Provider. CaptionMatch is not a party to the dealing, contracting and fulfillment of any such agreement. CaptionMatch has no control over and does not guarantee the quality, safety or legality of any services performed or deliverables created, advertised, the truth or accuracy of project listings, the background or abilities of Consumers, the ability of Providers to perform services, the ability of Consumers to pay for services, or that a Provider can or will actually complete a project. Thus, if an entity declines to pay for captioning of any sort, prior to or after the work is done, CaptionMatch will not be party to any legal actions.
CaptionMatch is not responsible for and will not control the manner in which a Provider operates and is not involved in the hiring, firing, discipline or working conditions of the Provider. All rights and obligations for the purchase and sale of services or other deliverables are solely between a Consumer and a Provider. CaptionMatch will not furnish any Provider with any materials or tools to complete any project. In particular, CaptionMatch forms and e-mails sent or received do not constitute formal work proposals or acceptance of formal work proposals. Consumers and Providers must look solely to each other for enforcement and performance of all the rights and obligations arising from agreements they make with each other and any other terms, conditions, representations, or warranties associated with such dealings.
The least expensive option for captioning is not always the best choice. In order to obtain an appropriate level of service, it is the Consumer’s responsibility to ask as many questions as needed of the Provider. Also, if the Consumer opts for a “remote” service, it is the Consumer’s responsibility to test it with the provider in advance – in the same location as the event, with the same microphones as at the event, and on the same day of the event if possible. For remote captioning, the Provider and Consumer may also want to agree in advance on a backup procedure using alternative communication technology, in case the original systems fail.
CaptionMatch reserves the right to charge membership fees, service fees, and processing fees for its services, as specified in the Fee Schedule on this website. Such fees may be changed by CaptionMatch at any time, at its sole discretion, and upon reasonable notice posted in advance on the website. No refunds of fees already paid will be given. If CaptionMatch exercises its right to cancel a membership as provided under these Terms of Service, at any time, we will not refund any membership fee already paid. At the present time, there is no membership fee.
